Little Miami Yak Shack – Terms of Use

Please read carefully. By booking or participating in any Yak Shack rental service, you agree to these Terms.

Welcome to Yak Shack! These Terms of Use (“Terms”) govern your interaction with Yak Shack, including rentals of kayaks, canoes, bicycles, and accessories, as well as transportation, group events, and all bookings made through our website or third-party platforms.

By using our services, you acknowledge and agree to the following:

1. Eligibility & Assumption of Risk

  • Renters must be 18 years or older. Minors must be accompanied by a parent or legal guardian.
  • You acknowledge outdoor activities carry inherent risks including injury, weather hazards, and water-related dangers.
  • Participation is at your own risk.

2. Reservations & Payment

  • All bookings are made through our online reservation system.
  • Full payment is required before equipment will be released.
  • Third-party platform fees (e.g., 4%) may apply.

3. Damage Protection & Liability

  • Optional Damage Protection is available (e.g., $5 for up to $200 in coverage).
  • Renters are responsible for loss or damage not covered under this plan.
  • Severely damaged, lost, or stolen items will be billed accordingly.
  • YakShack is not liable for injuries, property loss, or damages during equipment use.

4. Transportation & Shuttle Services

  • Shuttles are for YakShack customers only.
  • Transport is limited to designated launch and pickup points.
  • We are not responsible for delays or accidents outside our control.
  • All riders must follow shuttle rules and driver instructions.

5. Group Bookings & Events

  • Groups of 10 or more must book in advance.
  • A deposit may be required to reserve group space.
  • Group organizers are responsible for waiver completion and rule compliance by all participants.
  • Custom events may require special agreements.

6. Cancellations & Refunds

  • Cancellations must be made at least [Insert Hours/Days] before the scheduled start for a refund.
  • Weather or river-related cancellations will be addressed on a case-by-case basis.
  • No-shows or late arrivals may forfeit payment.

7. Data & Privacy

  • We use secure third-party software to process bookings.
  • Your data may be anonymized to improve services, but will never be sold or misused.

8. Conduct & Safety

  • Life jackets are required at all times while on the water.
  • No illegal drugs, excessive alcohol, or disorderly behavior.
  • Unsafe conduct may result in immediate removal without refund.

9. Jurisdiction

  • These Terms are governed by the laws of the State of Ohio.
  • Legal disputes shall be resolved in Warren County, Ohio.

10. Modifications

  • Yak Shack may update these Terms at any time.
  • By continuing to use our services, you agree to the latest version.
